Applicant Jagannath Putel a resident of Bharsuja village,Balangir District, Odisha he is a businessman and is a wholesaler of mobile phones & accessories.
Once, he sold mobile accessories worth Rs.48,000/- to a retailer. The retailer gave a cheque in return. When the applicant deposited that cheque in the Bank, it got bounced due to fund insufficient in the retailer’s bank account.
He was very furious and got panic. He discussed this matter with one of his friend who later advised to approach CSC and consult Panel Lawyer under Tele law scheme as his had also been benefitted under the scheme.
Following his friend’s advice, the applicant approached CSC, where VLE Manobodha Sahoo registered his case. Later, he was connected to Panel Lawyer where he briefed his problem. Panel Lawyer Amit Kumar Barick after listening to the applicant advised, first to get the memo from the Bank, mentioning reason related to check bounce. Send a legal notice to the retailer for demand to pay the payment. After sending the legal notice he was advised to wait at least a month for a response. If he does not receives a response within one month, then he should file a First Complain Case (Negotiable Instrument Act Section 138) to his nearest jurisdiction (JMFC or SDJM) Court after 15 days.
The same day the applicant sent a legal notice through speed post with the help of the Panel Lawyer to the retailer to pay the money within 15 days.
As soon as the accused got the notice, he immediately contacted the applicant at his Store and paid a partial amount of Rs.30,000 in cash and assured that the balance amount will give within one week and requested that not go to the Court and file case against him.
The applicant thanked Panel Lawyer and Tele-Law for guiding and helping him to the sent legal notice and provide instant help.
